For example, nonstate actors include organized crime groups, and to internationally criminalize this conduct would transform what is now a well-established domestic crime into an international crime. At least at this stage of world affairs, the legal elements of such a transformed crime would have to be carefully articulated. These include: the size of the perpetrator group; the quantum of harm required to be within the definition of CAH; the overall size of the civilian victim group; the geographic area within which the prohibited conduct takes place; and what is meant by widespread or systematic in this new context.
